This Privacy Policy Statement explains how Bright Power, Inc. (including its affiliated and associated companies and entities, collectively, "we" or "us" or the "Company") collects and uses personally identifiable information about users who use or visit our Company websites located at brightpower.com and energyscorecards.com (together, our “Websites”), including those users who access, use or register as a member of the Energyscorecards.com website (individually the "ESC Website").

We collect, retain and utilize personally identifiable information that is provided to us when a person registers with or uses our Websites including the ESC Website to make services and other opportunities available. The personally identifiable information we collect may include: a person's name, physical address, mailing address, billing address, email address, birth date, credit or debit card number, credit or debit card expiration date, other billing information, username, password, on occasion a unique identifier (for account security purposes), and other personally identifiable information that may be required for access to a utility account. We may associate and store this information with information about properties covered by our Websites including the ESC Website, the pages or reports which you may have viewed recently at our Websites including the ESC Website and and/or a history of any subscriptions and any communications you may have had with any of our representatives, including any problems with the service you may have reported and other non-personally identifiable information.

We may use your personally identifiable information (including your address) along with demographic data such as utilities usage information both internally and externally for ongoing analytics purposes, both in aggregated and user-specific form.

Activity Tracking:  Cookies and Other Web Technologies

We may gather information automatically about your use of our Websites through a variety of mechanisms, including server activity logging, browser cookies  and embedded scripts. This information is used to help us understand how users interact with our Websites, provide information to help us improve our Websites, and provide mechanisms for useful product features. We may share or transfer your personally identifiable information as directed to do so by you (for example, where you direct us to use your account information to obtain, compile and analyze energy usage data relating to your property or properties), or where you consent to such disclosure.

We may use third party vendors to perform certain services on behalf of our Websites including the ESC Website, such as hosting our Websites, hosting and managing the data, designing and/or operating our Website’s features, tracking our Website analytics, enabling us to send you information, or performing other administrative services. We may provide these vendors with access to user information, including personally identifiable information to carry out the services they are performing for you or for us. To the extent that we use third party analytics service providers to evaluate and provide us with information about the use of the our Websites and viewing of our content, we may share personally identifiable information with these analytics service providers, and they may set and access their own cookies, web beacons and embedded scripts and other tracking devices on your computer or mobile device.

We may transfer personally identifiable information to third party vendors who provide services that allow us to enhance the information we present to you either now or in the future, or who provide services that may help us provide additional services or features to you either now or in the future. For example, we may submit your data to the EPA Energy Star Portfolio Manager service, from which we may retrieve an Energy Star rating (if available) for your building.

We may, in our sole discretion, share or transfer your personally identifiable information to protect the security or integrity of our databases or our Websites including the ESC Website, to protect our business or reputation, to take precautions against legal liability, in the event of a business transition, to protect and defend our rights or property, for required institutional risk control, or for resolving disputes, inquiries or complaints with respect to your use of our Websites.

Furthermore, we may also provide our partners (and other third partners who might benefit from the information) with aggregated de-identified data, i.e., compiled data that does not in itself identify you, for research and commercial purposes.

Personal Data Submitted by You for Review by other Users

If you chose to post content (“User Content”) on our Websites including the ESC Website, you do so at your own risk. We cannot control the actions of other users with whom you may choose to share your personally identifiable information or other data. We cannot and do not guarantee that User Content you post on our Websites will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.
